These Terms and Conditions of Use ("T&C") constitute, together with the Commercial Agreement or Services Contract executed, a contract for the provision of payment acceptance services ("Services") and govern the relationship between the individual or legal entity ("Client") that uses the Platform (as defined below) for the purpose of selling its products and/or services ("Services Contract") and/or, where applicable, the Affiliated Third Parties and the companies directly or indirectly controlled by Kushki ("Kushki"). Unless otherwise agreed, the Client will contract the Services covered by these T&C with the Kushki subsidiary established in the country where the Client uses the Services, in which case the special terms and conditions applicable per country will also apply. By connecting to, registering for, and/or making use of the website, mobile applications, APIs, digital tools, and software owned by Kushki (the "Platform") and/or contracting our Services, the Client agrees to be bound in accordance with the scope of this legal instrument.
